Effective Date: July 2025 Applies To: acmesim.global, Android & iOS Apps ACMeSIM operating its digital services through its website and mobile applications (the “Service”). Please read these Terms & Conditions before using the Service. By accessing or using ACMeSIM, you confirm that you have read, and agreed to these terms and conditions. If you do not agree, you do not have our permission to use the Service. No agency, partnership, joint venture, or employment relationship is created as a result of these Terms.

1. Service Description

ACMeSIM provides prepaid eSIM-based mobile data services that enable users to access internet connectivity across multiple countries without requiring a physical SIM card. The Service is primarily designed for travelers seeking convenient and cost-effective mobile data solutions abroad. The Service is dependent on third-party telecommunications operators and infrastructure providers. As such, network availability, speed, and quality may vary based on location, device compatibility, and external factors beyond ACMeSIM’s control. Please ensure that your device is eSIM-compatible and not carrier-locked prior to purchase, as compatibility may vary depending on the device, carrier, and country of origin. You may verify eSIM compatibility by dialing *#06# and confirming the presence of an EID on your device. Please note that any compatibility list provided by ACMeSIM is not exhaustive and may not include all supported or newly released devices.

2. Eligibility

By accessing or using the Service, you represent and warrant that:
  • You are at least sixteen (16) years of age or meet the legal age of digital consent in your jurisdiction; and
  • You have the legal capacity to enter into a binding agreement.
ACMeSIM reserves the right to refuse or terminate access to the Service at its sole discretion, including in cases of suspected misuse or violation of these Terms.

3. Privacy Policy

ACMeSIM is committed to protecting your personal information and handling it in a secure and responsible manner. We collect and process personal data in accordance with our Privacy Policy, including information necessary to provide the Service, process transactions, improve user experience, and comply with legal obligations. By using the Service, you acknowledge and agree to the collection, use, and disclosure of your information as described in our Privacy Policy. While we implement industry-standard security measures to safeguard your data, no system can be guaranteed to be completely secure. Users are responsible for maintaining the confidentiality of their account credentials and ensuring that their personal information remains accurate and up to date.

4. Registration & Account

To access certain features of the Service, including purchasing and managing eSIMs, you may be required to register an account using email or third-party authentication providers. You agree to:
  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your account credentials
  • Accept full responsibility for all activities conducted under your account
You must immediately notify ACMeSIM of any unauthorized use of your account. ACMeSIM shall not be liable for any loss arising from unauthorized access due to your failure to safeguard your credentials. 

5. eSIM Purchase & Activation

eSIM plans offered by ACMeSIM vary by country, network operator, data allowance, and validity period. You acknowledge and agree that:
  • It is your sole responsibility to ensure your device is eSIM-compatible and not carrier-locked prior to purchase
  • Most eSIM plans are data-only and do not include voice or SMS services unless explicitly stated
  • Once an eSIM profile has been installed or activated, it cannot be transferred, reassigned, or reissued
ACMeSIM does not guarantee compatibility with all devices and shall not be responsible for service issues resulting from unsupported devices or configurations.

6. Charges

Payments for ACMeSIM services shall be made using valid debit or credit cards. All transactions may be processed in USD (United States Dollars) even if they are displayed in local currencies in the app or website. Payment processing is securely handled through trusted third-party providers. ACMeSIM utilizes industry-standard payment technologies, including secure encryption and tokenization, to protect your financial information during transactions. These measures ensure that sensitive payment details are not stored or exposed during processing. Our payment partner Stripe is compliant with globally recognized security standards, including PCI-DSS (Payment Card Industry Data Security Standard), which represents a high level of security and regulatory compliance within the payments ecosystem. By completing a purchase, you acknowledge to pay the relevant eSIM bundle charges.

7. Refunds

Due to the digital and consumable nature of eSIM services, refunds are subject to the following conditions: Refund Eligibility Refund may be granted only where:
  • The eSIM has not been activated and no usage has occurred
  • The Service fails due to a verified technical issue attributable to ACMeSIM or its network partners; and
  • The refund request is submitted within fifteen (15) days from the date of purchase and is subject to validation by ACMeSIM.
Refund Non-Eligibility No refunds shall be granted where:
  • the eSIM has been activated or any usage has occurred; or
  • any misuse, abuse, or fraudulent activity is detected.
  • Failure to verify device eSIM compatibility (e.g., absence of a valid EID on dialing *#06#) prior to purchase.
  • eSIM plans purchased under promotional offers, discounts, or special bundles
Fees and Charges All payment processing fees, transaction charges, currency conversion fees, and banking charges are non-refundable under all circumstances, including where a refund is otherwise approved. Processing Timeline Approved refunds shall be processed within fifteen (15) business days from the date of approval. ACMeSIM shall not be liable for any delays caused by third-party payment processors or banking institutions. Discretion All refund requests shall be reviewed by ACMeSIM on a case-by-case basis. ACMeSIM reserves the right to approve or reject any request that does not meet the above criteria

8. Acceptable Use of T&C’s

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall:
  • Only use eSIMs and the Mobile Data Service for consumer personal use during short term travel away from the user’s normal country of residence, with no user exceedingly more than sixty (60) consecutive days in any one country outside their normal county of residence;
  • Not use eSIMs or the Mobile Data Services for machine-to-machine transmission, internet of things-based services or in a router or other aggregation device (except tethering such that the User may use their personal mobile device to tether their personal tablet or laptop);
  • Not use the Services for any immoral, improper, obscene, defamatory, harmful, offensive or otherwise unlawful purpose;
  • Not use the Services in any manner which constitutes AIT; and
  • Only use the Services in accordance with the Acceptable Use Policy.
Violation of this section may result in immediate suspension or termination without notice.

9. Intellectual Property Rights

All intellectual property rights, including trademarks, logos, software, and content associated with the Service, are owned by or licensed to ACMeSIM. You are not permitted to use, reproduce, or distribute any part of the Service without prior written consent.

10. Third-Party Services

The Service may rely on or integrate with third-party providers, including telecom operators, payment processors, and analytics services. ACMeSIM is not responsible for the availability, accuracy, or performance of such third-party services, and your use of them is at your own risk.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. ACMeSIM makes no warranties, express or implied, regarding:
  • Continuous or uninterrupted availability
  • Network speed, quality, or coverage
  • Compatibility with all devices or systems
ACMeSIM is not responsible for detriments arising as a result, that the proposed service is not or not constantly available. ACMeSIM provides no guarantee of constant availability of the network service.

12. Limitation of Liability

To the maximum extent permitted by law:
  • ACMeSIM shall not be liable for indirect, incidental, or consequential damages, including loss of data, profits, or business interruption
  • Total liability shall not exceed the amount paid by you for the Service in the six (6) months preceding the claim

13. Termination

You may discontinue use of the Service at any time. ACMeSIM may suspend or terminate your access without prior notice if:
  • You violate these Terms
  • You engage in misuse, fraud, or illegal activity
Upon termination:
  • Any remaining balances, unused data, or credits shall be forfeited
  • Access to the Service may be revoked

14. Modifications

ACMeSIM reserves the right to modify or update these Terms at any time without prior notice. Where appropriate, updates will be communicated via the application, website, or email. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by the laws of Illinois, USA. Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes may be referred to arbitration or competent courts as permitted by applicable law.

16. Use of ACMeSIM Service

You agree to use ACMeSIM Services in compliance with these Terms and all applicable laws and regulations. You shall not use the Service in any manner that may disrupt, damage, or negatively affect the Service or its underlying networks, or for unauthorized commercial purposes. It is your responsibility to ensure that your device is eSIM-compatible and not carrier-locked prior to purchase. ACMeSIM does not guarantee compatibility, and no refunds will be provided for device incompatibility. ACMeSIM reserves the right to deactivate eSIMs that remain inactive for an extended period. Upon deactivation, any remaining data or credits may be forfeited without liability. You are solely responsible for all content and communications transmitted using the Service, and ACMeSIM shall not be liable for any misuse.
